It’s what separates mediocre attorneys from excellent attorneys. Laws are written in black and white but understood and applied in shades of gray. Laws, after all, must be deciphered, decoded, construed, and interpreted. The law changes constantly. If legal disputes were black and white, if it were clear who was going to win in advance, there would be little reason to pursue the dispute – and little need for lawyers. Every issue, large or small, can be resolved creatively and efficiently – you only get that which you and your attorney can successfully negotiate. Not every lawyer looks for creative solutions to problems because such solutions may short-circuit his or her billable hours.
